These Terms and Conditions (“Terms”) govern access to and use of the Ignis Wisper platform (“Platform”, “Service”), operated for Internet Service Providers (ISPs) and network operators. By creating an account, starting a trial, or using the Service, you agree to these Terms.
1. Who we are
Ignis Wisper provides billing, hotspot/PPPoE subscriber management, payments tooling, and related operations software for ISPs. References to “we”, “us”, or “our” mean the Ignis Wisper platform operator. “You” means the business registering as a tenant (ISP) and its authorised administrators.
2. Accounts and eligibility
- You must provide accurate business and contact details during registration.
- You are responsible for safeguarding login credentials issued to your administrators.
- You must ensure only authorised staff access your tenant portal.
- Self-registration starts on a trial plan; paid plans and onboarding fees may apply after trial as described at signup.
3. The Service
The Platform may include tenant portals, captive portal tools, router integrations, vouchers, wallets, subscriptions, notifications, analytics, and payment gateway connections. Features depend on your subscribed plan and enabled modules. We may improve, add, or retire features with reasonable notice where a change materially reduces core paid functionality.
4. Your responsibilities
- Comply with applicable laws in Kenya and any other jurisdiction where you operate, including communications, consumer, tax, and data protection rules.
- Configure your own customer-facing terms, support contacts, and payment credentials where required.
- Do not misuse the Service (abuse, unauthorized access attempts, spam, or infringement of others’ rights).
- Keep payment gateway, SMS, and email credentials secure and used only for legitimate ISP operations.
5. Trials, fees, and billing
Trial length, plan pricing, module fees, and onboarding fees are shown during registration or in your billing settings. After a trial, continued use of paid capabilities may require selecting a plan and settling applicable fees. Fees are generally non-refundable except where required by law or expressly agreed in writing.
6. Multi-tenancy and data separation
Each ISP tenant operates in an isolated tenant scope. You must not attempt to access another tenant’s data. You remain the controller of your customer and operational data processed through your tenant.
7. Acceptable use of networks and subscribers
You are solely responsible for your network, routers, captive portals, subscriber authentication, and the services you sell to end users. Ignis Wisper is a software platform and is not your ISP licence or a substitute for lawful network operation.
8. Availability and support
We aim for reliable availability but do not guarantee uninterrupted Service. Maintenance, third-party outages (including SMS, email, payment, or cloud providers), and force majeure events may affect access. Support channels and response expectations may vary by plan.
9. Intellectual property
The Platform, branding, and software remain our intellectual property (or that of our licensors). You receive a limited, non-exclusive right to use the Service for your ISP business while your account is in good standing. You retain rights to your own data and branding uploaded to your tenant.
10. Suspension and termination
We may suspend or terminate access for non-payment, abuse, legal risk, or material breach of these Terms. You may stop using the Service and request account closure subject to outstanding fees and lawful retention requirements.
11. Disclaimers and limitation of liability
The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We are not liable for indirect, incidental, or consequential losses, lost profits, or subscriber claims arising from your network operations. Our aggregate liability related to the Service is limited to fees you paid to us for the Service in the three (3) months preceding the claim, except where liability cannot be limited by law.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected on this page with an updated date. Continued use after changes take effect constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of Kenya. Disputes will first be addressed in good faith; unresolved disputes may be submitted to the courts of competent jurisdiction in Kenya.
